And give Bane credit, he's a genius. Genius bruiser for that matter. In order to deduce Batman's identity Bane strolled into Gotham and iniated a massive prison break of Arkham's imates. Batman spent three months rounding them all up and once he was done and went on to his manor, tired and clearly in no shape to fight another villain, surprise; Bane was waiting for him. What happened next was nothing short of a brutal beatdown.
However, for villainly points, I give them to the Joker:

Isn't this pretty much the plot of Arkham City?
....Where Batman easily finds a way to get out?

Not really Batman and everyone else had free reign in Arkham City so he could smash them all up I'm talking literally locked up with a bunch of crazies it would be maddening but Bane only wants to kill

That's more along the lines of justice, not anything evil.
Well, depends on who's doing it and for what reason.

You don't think letting someone live so they can suffer is evil?
guess it depends on how you look at it

I'm talking about at the start of the game. Bruce Wayne was arrested and strapped onto a patient bed. Even while locked onto it, he somehow managed to get a guard's panel and get out of it. He strolled around the jail meeting tons of previous villains. Even after getting knocked out, he managed to break his cuffs and beat the crap out of the penguin.

The reason Bane's the final villain is not due to his level of evilness, it's due to the fact that (based off the original Bane, not the downgraded one you see nowadays) Bane is the closest equal that Batman has. Bane is a strategic genius, that knows multiple martial arts and is incredibly powerful. The way Bane "breaks the Bat" in the comics, is not just a one on one fight. It was due to a large, elaborate scheme put together by Bane, to completely tire the Bat out, and then defeat him. In the comics, Batman basically gives up, because only Batman knows when a situation is absolutely hopeless. I believe Bane figures out Batman's secret identity as well.
